Abstract
KIE: Chantal Daigle became pregnant while living with Jean-Guy Tremblay, and decided to have an abortion after the relationship ended. Tremblay was granted an injunction by the Quebec Superior Court to prevent Daigle's abortion. Daigle's appeal to the province's Court of Appeal was dismissed on the grounds that, under Quebec's Charter of Human Rights and Freedoms and the Civil Code of Lower Canada, the fetus is a human being with a right to life. On further appeal, the Supreme Court of Canada rejected the Quebec Court of Appeal's interpretation and held that under the Quebec Charter and the Civil Code, the fetus was not considered a human being, and therefore had no legal right to life. Thus, the father had no legal right based on his interest in the fetus to support an injunction preventing its abortion.
